These Terms & Conditions (“Terms”) govern your use of the Jaxen Creek Drone Services LLC website and your interactions with Jaxen Creek Drone Services LLC (“JCDS,” “we,” “us,” or “our”) through this website.
By accessing or using this website, you agree to these Terms. If you do not agree with these Terms, please do not use the website.
1. WEBSITE PURPOSE
The JCDS website provides general information about our drone services, capabilities, service areas, projects, pricing where displayed, and methods for contacting or requesting services from JCDS.
Website content is provided for general informational and business purposes. Information presented on the website does not constitute a guarantee that a particular service can be performed at a particular location, time, price, or under particular operating conditions.
2. SERVICE REQUESTS AND QUOTES
Submitting a contact form, quote request, Lost Pet Search request, email, text message, telephone inquiry, or other communication to JCDS does not by itself create a service contract, confirm availability, reserve a flight or deployment, or obligate JCDS to perform services.
JCDS may need to evaluate factors including location, project scope, weather, terrain, access, airspace, regulatory requirements, equipment availability, scheduling, safety conditions, and other operational considerations before accepting a project.
Quotes and estimates are based on information available at the time they are prepared and may be subject to modification if the scope, location, conditions, customer requirements, travel, or other material circumstances change.
A service engagement is confirmed only when JCDS and the customer have completed any required authorization, agreement, quote acceptance, payment arrangement, or other confirmation specified for that service.
3. SERVICE AGREEMENTS CONTROL
Certain JCDS services may require a separate written service agreement, proposal, quote, authorization, or other contract.
When a separate agreement applies to a service, the terms of that agreement govern the applicable service engagement. If these Website Terms conflict with a separately executed JCDS service agreement concerning that service, the executed service agreement controls to the extent of the conflict.
For example, Lost Pet Search services may be governed by a separate Pet Location Service Agreement addressing the selected search package, search hours, deployments, travel, customer responsibilities, operational limitations, payment, cancellation, and other service-specific terms.
4. PRICING
Prices displayed on the website are intended to describe current standard pricing for the identified services but do not constitute a binding quote unless expressly stated otherwise.
Final pricing may depend on factors including:
Project scope
Location and travel
Number of deployments or site visits
Required flight time
Data-processing requirements
Deliverables
Access conditions
Airspace or regulatory requirements
Scheduling requirements
Additional customer-requested services
Other circumstances specific to the project
JCDS will communicate applicable pricing or obtain authorization when additional charges are required beyond an agreed scope.
JCDS may change website pricing prospectively. Changes to website pricing do not retroactively alter an executed service agreement or previously accepted written quote unless the parties agree otherwise.
5. DRONE OPERATIONS, SAFETY, AND REGULATORY REQUIREMENTS
All JCDS drone operations are subject to applicable federal, state, and local requirements and to the operational judgment of the JCDS Remote Pilot in Command (“RPIC”).
The RPIC retains final authority over the safe operation of the aircraft.
JCDS may delay, modify, relocate, suspend, or cancel an operation when necessary because of conditions including:
Weather or visibility
Airspace restrictions or authorization requirements
Unsafe operating conditions
Equipment limitations
Communications or navigation limitations
Property-access restrictions
Persons, animals, vehicles, structures, or hazards in the operating area
Regulatory requirements
Other circumstances that make the proposed operation unsafe, unlawful, or impractical
No website statement, customer request, quote, schedule, or other communication requires JCDS or its RPIC to conduct an operation that the RPIC determines cannot be performed safely or lawfully.
6. SERVICE RESULTS AND LIMITATIONS
Drone services are affected by environmental, technical, operational, and site-specific conditions. Unless expressly provided in a separate written agreement, JCDS does not guarantee a particular result from aerial imaging, mapping, inspection, thermal imaging, multispectral data collection, search operations, or other drone services.
Images, maps, thermal data, multispectral data, annotations, observations, reports, and other deliverables should be considered in light of the purpose and limitations of the service performed.
JCDS aerial observations and imagery are not substitutes for professional services that require separate licensing or specialized professional judgment unless JCDS expressly agrees in writing to provide such services through appropriately qualified personnel.
Customers remain responsible for determining how JCDS deliverables are used in their own business, property, agricultural, construction, engineering, veterinary, emergency-response, or other decisions.
7. LOST PET SEARCH SERVICES
Lost Pet Search services are intended to assist customers by using aerial thermal and visual imaging to search areas that may be difficult or time-consuming to evaluate from the ground.
JCDS cannot guarantee that a missing pet will be located, identified, captured, or recovered.
Search effectiveness may be affected by factors including animal movement, elapsed time, ambient temperature and thermal contrast, vegetation, terrain, buildings or other cover, weather, visibility, wildlife, access limitations, airspace restrictions, and other operational conditions.
Submitting a Lost Pet Search Request through the website does not schedule or confirm a search. JCDS will review the submitted information and contact the customer regarding availability and next steps.
Accepted Lost Pet Search engagements are subject to the applicable Pet Location Service Agreement.
8. CUSTOMER INFORMATION AND RESPONSIBILITIES
You agree to provide information that is accurate to the best of your knowledge when requesting JCDS services.
Customers are responsible for informing JCDS of information reasonably relevant to safe and effective operations, including known hazards, access restrictions, property ownership or permission issues, livestock, structures, utilities, towers, power lines, sensitive areas, and other conditions that could affect the operation.
Customers requesting services on property they do not own or control may be responsible for obtaining appropriate permission for access or operations where required.
Providing false, misleading, materially incomplete, or unauthorized information may result in delay, modification, refusal, or termination of services.
9. WEBSITE CONTENT
JCDS makes reasonable efforts to keep website information accurate and current. However, website content may occasionally contain errors, omissions, outdated information, or technical inaccuracies.
JCDS may modify, update, remove, or add website content at any time.
Images, project examples, descriptions, maps, reports, and other examples shown on the website are provided to illustrate JCDS capabilities or previous work and do not guarantee identical results for another customer, property, project, or set of operating conditions.
10. INTELLECTUAL PROPERTY
Unless otherwise stated, the JCDS website and its original content—including text, branding, logos, graphics, photographs, video, maps, reports, page designs, and other materials created or owned by JCDS—are owned by or licensed to Jaxen Creek Drone Services LLC and are protected by applicable intellectual-property laws.
You may view and use website content for ordinary personal or business evaluation of JCDS services.
You may not reproduce, republish, distribute, sell, modify, commercially exploit, or represent JCDS website content as your own without permission, except as permitted by applicable law.
Ownership and permitted use of customer-specific project deliverables may be addressed separately in the applicable proposal or service agreement.
11. CUSTOMER-SUBMITTED CONTENT
When you submit photographs, files, location information, project information, or other materials to JCDS, you represent that you have the right or appropriate authority to provide those materials for the requested purpose.
You authorize JCDS to use submitted materials as reasonably necessary to evaluate, plan, communicate about, document, and perform the requested service.

Submission of materials to JCDS does not grant JCDS unrestricted public marketing rights to identifiable customer, pet, or private-property imagery.
12. THIRD-PARTY WEBSITES AND SERVICES
The JCDS website may contain links to or interact with third-party websites, platforms, maps, payment services, social-media services, or other resources.
Third-party services are operated independently of JCDS and may have their own terms, privacy policies, security practices, and availability.
JCDS is not responsible for the content, operation, security, accuracy, availability, or privacy practices of third-party websites or services that JCDS does not control.
13. WEBSITE AVAILABILITY AND SECURITY
JCDS does not guarantee that the website will always be available, uninterrupted, error-free, or free from harmful components.
We may modify, suspend, restrict, or discontinue all or part of the website when reasonably necessary for maintenance, security, operational, or business reasons.
You are responsible for using appropriate security practices when accessing websites, downloading files, or communicating electronically.
14. PROHIBITED USE
You may not use the JCDS website to:
Violate applicable law
Submit fraudulent, deceptive, or intentionally misleading requests
Interfere with the operation or security of the website
Attempt unauthorized access to website systems, accounts, data, or infrastructure

JCDS does not warrant that website information will always be complete, current, uninterrupted, or error-free.
Nothing in these Website Terms excludes warranties, rights, or remedies that cannot lawfully be excluded.
Specific warranties or obligations concerning an accepted customer project, if any, are governed by the applicable service agreement or other written agreement.
16. LIMITATION OF LIABILITY FOR WEBSITE USE
To the fullest extent permitted by applicable law, JCDS will not be liable for indirect, incidental, special, consequential, or similar damages arising solely from use of or inability to use the website or reliance on general website information.
This provision does not replace or modify liability terms contained in a separately executed service agreement and does not limit liability that cannot lawfully be limited.
17. PRIVACY
Use of this website is also subject to the Jaxen Creek Drone Services LLC Privacy Policy, which describes how JCDS collects, uses, shares, and protects information.
The Privacy Policy is available through the website footer.
18. ELECTRONIC COMMUNICATIONS
When you communicate with JCDS electronically, you consent to receiving responsive communications through appropriate electronic means, such as email or text message, when consistent with the information and contact preferences you provide.
Where the parties agree to conduct a transaction electronically, electronic records, electronic acceptance, and electronic signatures may be used as permitted by applicable law.
Marketing communications, if offered, will be handled separately from ordinary communications necessary to respond to inquiries or provide requested services.
19. GOVERNING LAW
These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Any dispute concerning an accepted JCDS service may also be governed by the dispute, venue, or governing-law provisions of the applicable service agreement, if any.
20. CHANGES TO THESE TERMS
JCDS may update these Terms periodically to reflect changes in the website, services, business practices, or applicable requirements.
Updated Terms will be posted on this website with a revised effective date.
Changes apply prospectively and do not modify an existing executed service agreement unless the parties agree otherwise or applicable law provides otherwise.
21. SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by applicable law.
